CCW while on probation?

Instead of fretting about the severity of your criminal activity, wouldn't it be better to focus on improving your behavior and becoming an upstanding citizen? There are many support groups that can guide you along your journey. Ask google to help find a group in your area.

From reading the comments I think you want us to confirm your way of thinking. Like it or not Alameda County can deny you for whatever reason they want really, and it doesn’t have to be in writing. While identity theft isn’t a violent crime it’s also not great look. Have you purchased a firearm since the arrest?

Glad you understand. Alameda county is one of the stricter county's. In other places like YOLO or up north or down South, you'd have better chances. We're all pretty much saying its up to your IA, BUT these are the reasons they would use against you.

IIRC, the words "moral turpitude" are in the application somewhere. A CCW is not guaranteed to anyone, it is subject to approval. The issue at hand is who is doing the "approving".

I'd just add- be squeaky clean through your probation, everywhere in your life. Be able to get recommendations easily from lots of people, not so much as a parking ticket. Demonstrate and be able articulate in one paragraph how everything has improved. Make good judgement your M.O. in everything. Best of luck!

the penI think you're asking for an obective reason to an approval process that is clearly subjective. The laws cited say that the state looks at background details during assessments.

To chime in as I remember this post on the subreddit, most IAs are looking for people with squeaky clean records. To think that they'd give you one no problem with a fresh conviction hot out of the oven is quite... optimistic to say the least.

I applied for an Alameda County CCW back in May and in August I was arrested then took a deal shortly after for a misdemeanor identity theft (PC530.5a). I was sentenced to a year of unsupervised probation with no firearm restrictions. After researching up to date California law I can’t find anything that says I am disqualified by being on Probation for my specific charge as it is not a drug/alcohol or violent/gun related crime… They recently reached out for fingerprints should I continue with my application and just be honest or withdrawal for my refund and wait out the year?

If you think I should withdrawal if you can reference a specific code or law that’s up to date i’d really appreciate it!

you asked, so if you DO go forward with your application be honest . Honesty goes a long way and in this particular case they may lean in favor of approving the ccw because of your honesty. Plus this is the way to get an honest answer , potentially furthering your ability to obtain the ccw in the future in the event it is not approved now. Best of luck

Even if the probation has no firearms restrictions, it's still probation. I seriously doubt any agency will issue a permit to someone who is currently on any kind of probation. It would just look really, really stupid, like WTF were you thinking stupid, if that person messed up later on.

I have a violent misdemeanor that disqualified me from firearms for ten years but old stuff doesn't count. the squishy part of the current laws is "danger to society". This doesn't always mean violence it applies to any crime. But someone on probation has a suspended sentence typically, that means they are still under scrutiny and are still eligible to be incarcerated if they don't follow the rules. It's definitely going to come down to how the officers feel about the details of the case.
