CCW while on probation?

again im not here to argue just be educated, so let’s say i am denied which is clearly the likely outcome. what do you think the denial reason will state? That i’m a danger to others? That probation disqualifies me? That I make bad decisions?
Hard to say. It may not list a real reason, but a generic refusal.
 
Why not just try to apply and if you get in great and if not then ya wait
people were saying the first denial might make it harder in the future but honestly i think that’s my plan to just move forward and see what happens, i have like 80 more days to respond and submit my Live Scan so I can think about my next best move for a little bit

I’m interested in hearing what happens with this, too. Could you imagine a sheriff or police department in California approving someone to carry a concealed weapon while they were currently on probation? What would they do if the person then violated probation and got sent to jail — slip the loaded gun into a big Manila envelope along with their other personal effects and then give it back to them and watch them slip it inside their waistband again when they got released?

Interestingly, I have a buddy that has a DUI on record that has a ccw. It was from the mid 70's during his tenure at Berkley. He was able to plead his case. San Bernardino.
Surprised that would even be a factor today. I had a gun charge and an ex try to get a DVRO on me and still got my CCW (rightfully so)
 
I have a violent misdemeanor that disqualified me from firearms for ten years but old stuff doesn't count. the squishy part of the current laws is "danger to society". This doesn't always mean violence it applies to any crime. But someone on probation has a suspended sentence typically, that means they are still under scrutiny and are still eligible to be incarcerated if they don't follow the rules. It's definitely going to come down to how the officers feel about the details of the case.

Nobody here can guess accurately. Either do it and find out or don't

That was my comment. A formal denial IS not a good thing and you must disclose it wherever you later apply. Or as my suggestion stated, get ahold of the IA and explain your situation and (wait for it)- politely ASK them. Costs nothing but 15 minutes of time and will not be part of your documented application. Read the freakin room man, whenever possible.
 
It feels like a stupid question but legally speaking I don’t see why I can’t…

I applied for an Alameda County CCW back in May and in August I was arrested then took a deal shortly after for a misdemeanor identity theft (PC530.5a). I was sentenced to a year of unsupervised probation with no firearm restrictions. After researching up to date California law I can’t find anything that says I am disqualified by being on Probation for my specific charge as it is not a drug/alcohol or violent/gun related crime… They recently reached out for fingerprints should I continue with my application and just be honest or withdrawal for my refund and wait out the year?

If you think I should withdrawal if you can reference a specific code or law that’s up to date i’d really appreciate it!

I seen 26202 does mention being on any active court order but it’s referring to specific types of stay aways and restraining orders etc which don’t apply to my situation… Is there any one that has ever had a ccw while on any type of probation?
I work in this industry and I would advise you most general probation terms, regardless of the nature of the conviction, include a “do not possess a deadly weapon” condition.

On a summary (unsupervised/misdemeanor) probation case the public defender who represented you (or whoever your counsel was) should still be able to get you a copy of your conditions. If that doesn’t work out the district attorney’s office of the county having jurisdiction over your case should be able to provide them to you as well.

I dont even think you can have pepper spray on probation. Id read your conditions of probation.

Like your under state/county supervision for conviction crime. Why would they say. This dude can have a gun on him. Try when your of probation for awhile.
