DUNCAN V. BONTA GOES TO SCOTUS CONFERENCE - California Large Capacity Magazine Prohibition

I wonder if any currently USSC accepted 2a cases could affect Duncan. Possibly cause Duncan to be granted and remanded back to the 9th.

Supreme Court took Rahimi already couple years ago, so I doubt they gonna take Duncan this term. The majority opinion in Rahimi set a bad precedent for future 2A cases.

what part? both Heller and Bruen stated that 2a rights are not unlimited and are subject to regulation

Ruling? They haven't even heard the case. If history repeats itself. We will get a dissent from the usuals saying the importance of hearing a case like this but not this time, try again 😆

No case decision is produced from a conference. The purpose of the conference is to determine if a request for certiorari will be granted. In the very few cases where it is granted, the case will then proceed to argument and then decision. The court normally releases the conference results on the Monday following the conference.

Is there a limit of how many times it gets rescheduled before a decision is made about granting or denying cert? Or is it just indefinite?
 
They looking at Hawaii now so hopefully?
Wolford (Hawaii?) was heard this week. It deals with CCW carry restrictions, specifically the Vampire Rule, and while it may marginally touch on the areas of Duncan, it doesn’t appear to provide direct impact on Duncan. At any rate, they most likely won’t publish the Decision until the end of term.
 
Gents, The fact that this is getting continually rescheduled is a sign that the justices are struggling with the case. The court is closely divided on Second Amendment cases, and the justices are careful to select cases where the case facts closely align with an issue that they collectively want to settle. Duncan has the potential to be such a case.

It's really a coin toss how it will end up if they do hear it. Every 2a case since Heller has affirmed that regulation on "dangerous" weapons is constitutional. This could include anything whether it's semi automatic rifles or magazines with certain capacities depending on who is interpreting the case law. Bruen specifically allowed the licensing scheme we have to deal with in Ca for instance so we know even "conservative" justices have opinions in favor of regulation. So far that's been the overall flavor of these cases, that we are allowed "arms", but not any "arms" and only if you are a good boy.
