Ccw hypothetical

Like I said earlier, I should have phrased the question better in my original post. Appreciate the responses. We as residents in CA are so inundated with laws like these. Good reminder to always read what these laws are. However, we do have "cowboys" out there doing whatever they want. Like speeding, I know a coworker that's been caught speeding a 100 plus a couple times over his life. Laws say that's a misdemeanor and possibly license revoked . He's never once had his licensed revoked and drives a vette like an 🐚 to the office everyday. I wish the state would take his license away, really they should have but here we are.

For context, I drive speed limit every where for the safety of myself and those around me.
 
No, only a felony if the firearm isn't registered to you (or perhaps could be read as unregistered).

If the firearm is registered to you but not on your CCW, then you could be charged with 2 misdemeanors -- one for carrying without a permit and another if carrying said firearm loaded.
I thought I saw that California made it a felony to carry without a license regardless of registration when they passed all the other anti CCW stuff.

I have a friend like that, he's into rally racing and has a pile of crashed Subarus in his yard, he's totaled every car he's ever had since high school 25 years ago. He finally bought a big ass truck and it's slowed him down quite a bit. I've told him many times that his penalty for 20 years of driving like a menace should be having to drive a 1992 toyota tercel for the rest of his life.
 
They passed a lot of stuff with sb2 in regards to actual ccw holders on where to carry . Got the legislation cut in half thanks to CRPA and other organizations (thank you !). With people that are not licensed, I am sure that has changed in favor of CA DOJ. Last I checked , as someone posted earlier , it's a wobbler but can potentially be a felony .

Or licensed revoked. The state has a lot of good language in their books to keep people like this off the road but once again here we are . I feel like 30% of people with drivers licenses shouldn't have one .

but this is America, the land of sprawl and bad public transportation. If you are poor you lose your license but if you have money for a lawyer they can negotiate down those points on your license. Ive seen it happen with that same guy over and over lol. "Your honor he knows the severity of his 6th speeding ticket but the fact that he spent so much money on his attorney shows that he is working in good faith to remedy his actions."
 
fun fact. Most accidents happen at speeds less than 20 mph. And, there have been examples (like Montana) where they opened the freeways to unlimited speeds and traffic fatalities reduced.
Yeah speed laws are pretty much useless, especially highway speed limits which harken back to the oil embargo and were meant to reduce fuel consumption more than anything else. Most people tend to drive a speed at which they don’t think they’ll die… those that drive recklessly usually don’t follow any of the laws anyways. We should remove all hard speed limits and leave reckless driving laws on the books. No reason I should have to go 70 on I-5 in a straight ass line with no cars around for 400 miles to SoCal… make America Germany again (in an autobahn sense)!

And don’t carry a gun not listed on your permit, that would be immensely stupid.

You have your issued ccw permit. However , you are pulled over and you are carrying a pistol that is "not listed " on your permit . What are the potential problems you will have to deal with ? I imagine something along the lines of IA revoking your permit ?
Try not to have them figure that out… shut your mouth. Otherwise felony and no more guns. Don’t carry like this
 
As my IA explained it to me, I am not licensed to conceal carry any firearm that is not listed on my permit. Essentially, it would be treated as if I was carrying a concealed loaded gun without any permit at all.

What an odd response; did I say anything about breaking the law? I said speed laws are useless and have no basis in public safety or reducing accidents or injuries. I advocated for changing the law to something similar to Germany where you can travel at whatever speed you feel is safe on certain highways, and for maintaining reckless driving laws so people can still be cited for doing something unsafe. A hard limit on speed on highways is a stupid law and should be changed. It’s the exact same nanny state “taking away rights to protect people for their own good even though they’ve done nothing to cause anyone harm” rationale that results in our absurd gun laws.

I’ll echo the poster above and say I hope you’re not one of those people who sit in the left lane on the freeway going 65mph; if so, you are in fact breaking the law in CA if you aren’t actively passing someone and THAT behavior actually DOES cause accidents as it forces other drivers to change lanes into traffic and pass on the right unnecessarily.

I also clearly advocated for following CCW laws and not carrying a non-permitted gun.

You sound like the type of person who would have supported ghettoization of Jews in Germany in the 30s or extermination of the kulaks because “the law is the law.” We have a very different conception of the purpose and derivation of governmental authority.

Yes, as everyone else has chimed in on emphatically. Same with traffic laws , they are codified in traffic laws and their are penalties for people that break them . Do I agree we should roll back some laws in regards to traffic ? Yes.
But here we are playing this game.
 
All I asked was a hypothetical question , as niche as it is in regards to ccw laws. Then I get raked over the coals for following traffic laws lol. I hope everyone sees this 😁

I may have been a bit more hostile than needed, sorry about that lol. Your response seemed to indicate I was advocating for breaking the law which I wasn’t; I was just disagreeing that driving the speed limit is “safer” and suggesting we should try to change the law to align with that. That being said, I think when we’re in a situation where there are tens of thousands of laws and regulations governing the activities of our daily lives, sometimes it’s not possible to have them all memorized and front of mind at the time, and we have to fall back on good judgement and apply our own ethics to the situation.

I also think sometimes “the law is the law” is really not true, there is often so much ambiguity and gray area in legislation, even more in regulations, and some things have been litigated (which brings clarification) while others have not. So there is a LOT of gray area where we have to use our common sense and ethical judgement, and PART of that equation is based on what the penalties are for “getting it wrong.” A good example is those braces for pistols that came up on here recently. Do they make the pistol an assault weapon or not? If you read the thread, it’s a bit of a gray area that has not been tested in court. I would shy on the side of caution there and not buy/use one because the potential repercussions are really serious.

On the other hand let’s say an on-call doctor is rushing to the OR for emergency surgery and the sooner he gets there, the more likely the patient lives. Should he go 85mph on a dry, well-lit and sparsely traveled freeway to get there 5 min faster even though that is breaking the speed limit law? I would say yes, given the repercussions on either side of the equation (death of a patient versus a speeding ticket).

Your initial example of carrying a non-permitted gun, to me, is also CLEARLY on the other side of the line - 100% not worth it because the consequences of breaking that law are rather large weighed against almost no “good” coming from breaking it. Now, if someone is living paycheck to paycheck and REALLY can’t afford to go through the CCW process in a really restrictive county where it costs several thousands dollars to go through, and they live in a high crime area or are a woman being targeted by a stalker for instance, that sort of changes the equation. I’m not saying they SHOULD carry in violation of the law in that scenario, but it IS a different question in a significant enough way that just saying “the law is the law” doesn’t really cover the complexity of the situation.
 
I blame myself for this whole thread lol. I should have said how is this type of violation charged in practice vs just what's written as law . As said , I have never read an article for such a unique charge . I agree with all that's said about not a good idea to carry non listed weapons outside of permit . Also the current ccw laws in our beautiful state are bogus and some could argue (not me) that they won't follow them , which I would support , but I ain't paying for their bail lol.
