Ccw hypothetical

Don’t push your luck. Carry only what is on your permit. My son in law is a Sac PD officer and he was called to a scene one day to check on a person who dropped a loaded magazine at a local hospital. Sure enough, the guy had a corresponding pistol with him, but he was a few weeks away from his first CCW permit. Let’s just say his life changed radically that day.

You have your issued ccw permit. However , you are pulled over and you are carrying a pistol that is "not listed " on your permit . What are the potential problems you will have to deal with ? I imagine something along the lines of IA revoking your permit ?
Carrying a pistol not on your permit is the same as not having a permit at all. You can go to jail
 
I thought I saw that California made it a felony to carry without a license regardless of registration when they passed all the other anti CCW stuff.

The Penalties For Carrying a Concealed Weapon​


Without evidence of aggravating circumstances, the maximum penalty for carrying a concealed weapon is one year in jail and/or a $1,000 fine. Depending on the facts of your case, you may also qualify for probation. The facts that a judge will consider in determining your punishment are:


  • Your criminal history
  • Whether you’ve committed acts of violence in the past
  • Any evidence that you intended to use the gun
  • Your failure to cooperate with the police

On the other hand, your carrying of a concealed weapon may be treated as a felony under the following circumstances:


  • You have a prior conviction of a felony or any California firearm offense
  • You were carrying a firearm that you knew to be stolen
  • You’re a gang member
  • You possessed the firearm unlawfully
  • You are prohibited from carrying a firearm owing to a previous conviction or a restraining order
  • You were previously convicted of a misdemeanor against a person or property
  • You have previous narcotics or dangerous drug-related convictions
  • You were carrying a loaded firearm of which you were not the registered owner (but the police must have probable cause of this specific fact when they arrest you)

If convicted of the felony version of carrying a concealed weapon, you may face between one and three years in jail and / or a fine of up to $10,000.
 
I blame myself for this whole thread lol. I should have said how is this type of violation charged in practice vs just what's written as law . As said , I have never read an article for such a unique charge . I agree with all that's said about not a good idea to carry non listed weapons outside of permit . Also the current ccw laws in our beautiful state are bogus and some could argue (not me) that they won't follow them , which I would support , but I ain't paying for their bail lol.

I think a lot of folks miss that even though it's a wobbler, if you're convinced of the misdemeanor you forfeit your gun rights for 10 years.

Thank God I got that charged dismissed in the interest of justice, and before 2026 it didn't have a rights ban. That's so crazy
