I have OCSD interview in a week, but I just received wage garnishment notice for credit card debt filed year 2020. I got divorced and moved to different address. I changed work also because of life changing situation. Other than that, I have a clean record. I disclosed it in the application the moment I received it. Is it going to affect the approval?

I'm not an expert etc, but I would doubt it as long as you have a valid explanation (divorce should cover it!)?

They're more interested in criminal proceedings and arrests, drinking and drugs, plus violence of any type IME.

I suggest being honest as they're also interested in honesty and moral compass.

Good luck!

Answer all questions asked. If they don’t ask, there’s no need to answer. That said, I do recall all application, initial and renewal, does ask if you were name in any “lawsuit.”

As far as I know, there are no consideration in regards to your credit history. Only legal action like arrest, being named in actual lawsuits and etc. I didn’t have perfect credit when I initially applied but that didn’t affect my approval nor did being name in a civil lawsuit.

For my first renewal, I reported that I was named as both a plaintiff and a defendant in a “breach of contract” category lawsuit, which I disclosed in my renewal application. I was approved for my first renewal.

For my 2nd renewal, I disclosed in my application that said lawsuit have been settled outside of court and dismissed. I was approved again.

Since you receive a garnishment order, that means there’s a judgement against you. A CC company cannot easily garnish your pay without a court order. Sounds bad, but it’s a civil contract case. Just disclose it, I don’t think it’s going to hurt you. Just be transparent. During your interview, they will ask you if you have anything else that was not on the application you want to disclose. They might even hint they see something that you did not disclose or they might not. This is why it’s best to be transparent. Good luck!

I have a bunch of lawsuits arising out of my law practice, plus one recent frivolous case against me by a disgruntled former client. Made no difference to the decision, although they told me during the interview that they had reviewed the entirety of every single case on the court portal to see the details of what the cases were about-- plus they reviewed the entirety of my extensive portfolio of websites and everything I had written on them. I was actually impressed at their level of attention to detail. Funny they care so much in this scenario, as opposed to normal law enforcement work where they can be careless and indifferent.

Regarding the credit card debt, if it is a large amount that has gone to judgment or if there are multiple judgments showing a pattern of non-payment of debts, they would probably use it against the applicant as a moral character issue. Also, if there is a pattern of disregard for debts, judgments, etc., that certainly clusters with other behavioral and mental health problems, as well. So they are going to be looking at the application under a microscope if they see that red flag.

The interviewer was awesome and on the day of the scheduled interview, she called the 3-character references prior to my appointment. She went over my application and basically reviewing what I answer in the app. I disclosed the garnishment in the app and when she asked about that I explained that it was 5 years prior when the time I get divorced, though I indicate that too in the app. But the court judgement just came recently. She downplays it and her comment is it happen that life event changes to many people. Then she asked about if I have criminal or traffic lawsuit and I said no, which I actually really have clean record except to that civil case. She told me to keep it that way and she proceeded explaining the next step which is the final review. In two weeks, I received the approval email and another two weeks the permit in mail.

It really helps disclosing it in the apps so that there will be no surprises on their part. She even advises me to email or call her if it's past two weeks and I didn't get an email on the result of final review. They are really concern about criminal and mental records.
