I had a medical event today going home from work. Had to pull over on the freeway and call 911. I have heart issues and thought I might be having a heart attack. I got really dizzy, everything started spinning, almost blacked out. It was all I could do to pull over without crashing. I was concerned about freaking out the medical personnel when they showed up so I hid my firearm in my trunk ( my car has automatic fold down , fold up rear seats that can be operated from the infotainment screen) so I folded down the seat and slid my firearm into the trunk, folded the seat back up so my firearm would be locked in my trunk.

Anyway, CHP showed up with paramedics. I informed them I was a CCW holder and that firearm was in my trunk and wasn't sure what to do since I knew I was going to be taken to the hospital. Surprisingly, he was up on SB2 and informed me I could take it to the hospital with me but would need to conform with his watch commander. His watch commander agreed but stated he advised against it because, well, hospital and they would probably freak out. They offered to take it into custody and give me a property receipt to pick it up when ready. I took them up on their offer.

Anyway, do you guys think this constitutes a negative contact? My understanding is that I have to be the subject of some kind of negative interaction initiated by law enforcement. This obviously wasn't. Do I inform my IA (LASD)? Not sure what to do.

Has anyone else had something similar happen to them?

Sure, why not. Write up the same thing you wrote above, and send it to them. At worst, they can ignore it. You are clearly showing good will, and this is not a false police report, and you're not filing it with intent to harass them.

By the way, you do know that to retrieve the gun a LER (Law Enforcement (gun) Release) form will be needed, from the CA DoJ? Which according to stories on the web can be a bit of a hassle, and used to have a very long wait; but recently, people report that it only takes a month or two. I think you can request it online, not sure.

And: best of luck with your health!

Thank you for the reply. I was thinking of doing as you suggest. Just for good will, as you state. The officer told me it might be a pain to get back. Thats fine. Just got home from ER and glad to be alive.
 
Glad you're discharged (no pun intended) and alive!

Report it and see what happens. At the very least, your IA would probably want to know why your firearm was in the possession of another agency. In this case, you had a medical emergency, it's not like you were an active participant in a crime/SD situation.

The way I see it, honestly goes a long way with your IA (hopefully). They may see you as less of a concern and that you actually followed their protocol.

Not the exact scenario, but I had LE contact when I was helping my parents with retrieving surveillance footage for the police. I was carrying as I was tinkering wit the device and didn't think much of the incident at the time. I later reported it to my IA, they replied back with, "Thanks for letting us know" and that was it...

I reported it to them (LASD) today. Email and phone call. Surprisingly got a person and not a voicemail. They said "thank you for letting us know."

I also started the process for getting back my firearm. Fortunately, I already have a CFARS account, so just had to log in and fill out the Law Enforcement Release request for the firearm. I will report back when it's returned so everyone has a timeframe to reference in case they have the misfortune of this happening to them as well. I will also post any other significant developments.

Though it's not the same scenario; I had a buddy who had to surrender all of his firearms to the Sheriff's Office as part of a court order (not a misdemeanor/felony, it was due to custody over his child). They held his firearms for a good 60+ days after the case ended (I'm sure shortstaffed Sheriff's Office didn't help) and all of his firearms were disassembled - handguns (when possible) separated upper/lower, ARs were broken down to the pins, etc.

It was already enough that he had to be without his pews, but to have to put everything back together was another thing.

Hope it all goes smoothly for you when you recover your firearm!
 
Is this reporting based on each IA’s policy? I don’t see anywhere in my IA’s policy that says anything about reporting any police contacts whether it be positive or negative. Does having police contact to have a deer tag signed by LEO need to be reported to the IA; especially if it doesn’t list anything in the policy about police contact whether it be positive or negative?

I believe it's ANY LE interaction may need to be reported, not necessarily a "negative contact". My understanding this duty to inform is based on each IA / County policy, check with your County.

There terms of use agreement states "when contacted by law enforcement..." it doesn't give any guidance if you're the one who initiates contact. I preferred to err on the side of caution. Plus, I knew I was going to be going to ER and actually wanted to ask the officer if he could take custody of the weapon. I didn't want to take a chance on losing control of my weapon at any point.

This is the second time I've initiated contact. Last year, some punks tried to break into our home. We were able to scare them off through speakers in the camera system. When police arrived to take a report I informed them I was carrying as well.
 
You didn't need to let them know but it was a good idea you did.

As a CCW license holder, I agree to abide by the following conditions:

1. Obey all laws and local ordinances.

2. While in possession of a firearm, I will not consume, ingest, or be under the influence of

alcohol or narcotics, including those prescribed by a doctor.

3. Only those firearms listed on my CCW license will be carried on my person. I will carry

no more than two weapons listed on my CCW license at a time.

4. Notify the CCW office via email within three days of any arrest or any negative law

enforcement contact (arrested, cited, questioned, detained), including any time I am

named as a subject in a restraining order.

5. Notify the CCW office via email within three days of any incident involving use of or

display of a firearm.

6. Notify the CCW office via email within three days if your CCW license or firearm is

lost/stolen. A police report must be filed with the responsible jurisdiction.

7. If I am contacted by a law enforcement officer for any reason, and I am armed, I shall

immediately advise the officer that I am a CCW licensee. If the officer requests my

CCW license, I will provide my CCW license as proof I am legally carrying a

concealed weapon.

8. Notify the CCW office via email within ten business days of any change of residence.

9. My issued CCW card must be on my person anytime I carry my firearm.

10. Licensee shall not unjustifiably display/brandish any portion of a firearm or

CCW license.

11. The following will result in automatic revocation of CCW License:

• failure to show license to any peace officer upon demand.

• failure to surrender firearm to any peace officer upon demand.

• failure to store weapon properly.

• impeding or interfering with any peace officer.

12. Possession of a firearm while in any of the following locations, or under any of the

following conditions, shall be considered a violation of this agreement and the licensee’s

responsibilities, which will subject them to revocation of their CCW license:

• possession of a firearm at any place having primary purpose of dispensing alcoholic beverages

for on-site consumption.

• possession of a firearm at any airport or on a plane where prohibited by law.

• possession of a firearm at any school building and/or school grounds where prohibited

by law.

• possession of a firearm at any city, county, state, or federal building where prohibited

by law.

• possession of a firearm at any government facility where prisoners are housed.

• possession of a firearm at any other location where firearms are prohibited by

law.

• possessing a weapon or equipment altered from its originally approved and inspected

condition, or weapon not listed on the license.

• possessing any illegal equipment or attachments to a firearm or any other act,

omission, or commission, deemed by the Sheriff to violate these regulations and/or

the Sheriff’s reasonable expectation of sound judgement and responsible conduct.

13. Violation of the above terms may result in the denial or revocation of my CCW

license.

Glad you're okay! Good luck getting it back quickly. Informing your IA shows good faith and diligence.
 
I think if this became a common occurrence. They could be try to jam you up on your ability to keep your firearm safe an secure. But you should be fine. On your renewal form just add it to a question that asks for extra infor with your call for service's number and whatever else you have.
