How would you handle this as a CCW holder?

So would everyone placate the guy and show ID and hope he doesn't shoot you or would anyone shoot him first before he shoots you
 
Same here. Only way its coming out of the holster is so it can get to work. I don't know how that state defines "brandishing", but in my book its more than mere display of a weapon and talkng 💩 doens't qualify. I'd expect a willful and apparently able attempt to put fear into another person. Standing their with it in your hand not pointed at anyone or thing wouldn't meet sufficient criteria. Gonna need a totality of circumstances higher than what we can see there.
It's almost the same exact wording as in CA

In Florida, brandishing a firearm is legally classified as the "improper exhibition of a dangerous weapon or firearm". Under Florida Statute 790.10, it is a first-degree misdemeanor to exhibit a firearm in a rude, careless, angry, or threatening manner in the presence of one or more people.

“rude” does not mean merely impolite or socially discourteous. It means displaying the firearm in a confrontational, provocative, intimidating, or hostile manner under circumstances where the gun is being used as part of the confrontation.

Written in 1872 by the way and still used today in CA for brandishing.

My thoughts too. It comes out you don’t use it you get a brandishing charge. Use it it’s self defense. But at time it some out I have already decided I’m using it.

Re: the original post, the old guy acted ridiculously and I would never brandish in that scenario. Also what is the point of an ID with no terminal? It's like asking for a credit card as payment and then just holding it for a second and handing it back.

Well, that’s why lawyer get the big bucks. They decide what “threatening manner” means. Seemed more retardid than threatening to me. But I’m not a lawyer, judge or serving on a jury ATM so my opinion amounts to nothing.


If it was threatening manner then the retard possessed means motive and opportunity. I would assume shooting the retard would be a clean shoot.

The old fart went out of his mind. I am just wondering if he happens to be a Sheriff's relative. Otherwise, I don't understand why he didn't end up in cuffs.
 
I can tell you what I think I would do, but take it with a grain of salt as I am sitting on the couch not talking to an unreasonable ass holding a gun. I would like to think I would call LE and let them know what was happening. I would like to think I would not provide ID unless he raised his gun to point at me. Then I would do whatever I needed to to go home safe and that would not be drawing on him unless his back was to me after pointing his gun at me or my friend/coworker. Likely I would just provide ID and then piss and moan that LE did nothing after the fact.
 
I have always been told that reaching for something on a top shelf (say in a store) and your concealed weapon is exposed a karen could complain and you could be charged with brandishing. This dud is a racist an idiot and a dumb f**k. Should have been charged.
