Crazy lady assaulted my wife

Someone's dermal pigmentation is extremely useful in identifying or ruling out possible suspects, and that is not inherently racist at all.

Of course. You're right. But if someone on a public forum makes derogatory comments about the person's name, I don't know if they're racist, but they're being a 🍆. Too much of that sort of nonsense can drive upstanding people away from a forum.

Even when I was a little kid, I recognized that the left needs to season their ideology with a healthy dose of pragmatism, while the right needs to temper theirs with a fat chaw of empathy.

It honks me off to see good ideas get ruined with insanity.

At the Arden mall today a random middle aged black lady walked up to Mrs. Gawer while she was sitting down, out of NOWHERE, pulled out a pepper spray and said I will spray you and pointed it at her. She quickdrew her Sabre OC Spray I got her and said "no, I have mine" and the lady walked away.
WTF Sacramento?

Wasn't exactly a CCW moment yet but getting there, I'm still dumbfounded at what happened. Not sure what I was even supposed to do.

how i imagine you 🤠 way to go though seriously

Not that many years ago, the college campus where I teach in the evenings, the campus security sent out a warning about someone robbing college students right off campus and provided description (two tall black males). A few days later they had to issue a public apology regarding race. I sent them an email saying I was sorry they had to put up with such liberal crap.
Let me guess SF State?

Kind of surprised that the tv series Blue Bloods (which is awesome) ever got made as just about every episode has this dynamic tension in it. Seemed to be too conservative of a show for the networks to run and it did for 14 seasons.

Sac is ducking crazy. Especially the Arden Arcade area.

Sorry to hear dude. Glad no one was hurt
Yeah sac is crazy.
I had someone open fire on me over a traffic incident at 7am on my way to work a few months ago. A round came through the back quarter panel, through the middle my driver headrest and hit the rear view mirror directly in front of my face. Still not sure how it didn’t hit me in the head. 3/4 of my headrests had bullet holes in em. Cops didn’t do a thing.

No I don’t think it was like that at all. Just line of sight targeting and sadly Arden is known for being super ghetto
I try to avoid Arden mall and nearby restaurants, too many sketchy people in the mall / parking lot and minimal security. Roseville Galleria has some issues but not nearly to the level of Arden

It’s usually the Apple Store I end up going to. Oddly the mall itself is decently nice inside. But outside near the bus stop might as well be a fight club

Thanks, me too. I’m confused on what even happened. There were other people sitting next to her and the woman just focused on her for some reason. Had a wig or weave and a bandana and just pointed the spray with no provocation for no reason.

What do you even do? Pretty sure you can’t shoot someone for pepper spray.

Also, my wife is from Colombia and is confused why someone attacked her unprovoked and I don’t have a good explanation either. Welcome to California I guess.

I am also shocked she got the spray out that fast because she has 0 practice using it pretty much.

@dvoncock what’s the attorney approved response? Can you punch them?
Reasonable force includes an element of proportionality baked in.

For example, if someone spits on you, that’s 100% a battery, but lethal force would not be legally justified. Nor would be displaying a firearm in that hypothetical. Brandishing a firearm is, generally, considered a threat of deadly force and actually discharging a warning shot is considered using lethal force, so both must be reasonable and proportional to the threat presented.

From what you describe, deploying a chemical agent in response to an unprovoked brandishing likely would’ve been legally justified.

[As always, I’m not your attorney and this is not legal advice.]

I understand that. I’m just wondering what’s the proportional force if someone pepper sprays you?

And then if it escalates … like the woman sprayed then started attacking - I hate the legal grey areas like that. The answer is going to be “it depends”

No doubt, especially in a regional forum like this. It is good for locals to have an accurate description. That being said, Jcwatchdog's post was totally racist, haha. Gtfo of here with that BS.

It’s funny that when I made that comment it was a joke, but you knew exactly the type of person I was talking about. Not all people fit in any one bucket, but some people do fit in that specific bucket.

Offended by everything, ashamed of nothing.

Unfortunately, the answer is necessarily “it depends” because every situation is unique. The touchstone is always going to be reasonableness of fear, under the totality of circumstances known to the defender, judged from an objective person standard. While not satisfyingly black and white, it works as an analytical tool.

it is all part of a bigger agenda occurring. it seems like all this recent times of psychosis began right after the COVID shot. humans and society were not this irrational, erratic, and irate before those shots. there is also the agenda of destabilizing america. i do not understand how we came to a point to where we have terrorists as our officials and in our government, for that matter. activist judges and corrupt courts, and this agenda of the World Economic Forum, UN, and the World Bank's move to make a totalitarian society. we, the citizens, are allowing all of this. all anybody does about it is just sit in front of a mic and talk about it nowadays. we need to rise up and stop allowing this
