Buying OEM magazines and AB 1263

California lawmakers recently passed a new law, AB 1263, affecting certain firearm accessories, components, and equipment. Magpul is upgrading its systems to meet the requirements of the new legislation.

Key portions of this law are scheduled to take effect January 1, 2026.

AB 1263 imposes age and identity verification requirements, acknowledgment requirements, and strict shipping requirements related to the sale and delivery of firearm accessories, parts, and equipment capable of producing firearm components. Read the full text of AB 1263 here.

I reread the bill. The bill is amending five sections of existing law and adding two new sections. I see nothing in the amended parts or the new sections that speaks to the existence of such a clause. I'm trusting https://legiscan.com/CA/text/AB1263/id/3186791 to accurately identify which parts of the bill constitute changes to existing law.

Unfortunately a nervous vendor might fear a crazy argument by a prosecutor who claims that the materials used in a third-party magazine somehow improve performance over an OEM one. Such a crazy argument is not even possible if one were ordering an OEM magazine. Such a nervous vendor might require proof of identity for a third-party magazine but would have no excuse to do so for an OEM magazine.

That's kind of what I'm getting at by focusing on OEM magazines. Was there any excuse that gunmagwarehouse.com required my drivers license when I ordered stock Sig magazines from them? I haven't found anything in the bill that justifies their behavior for these items (even though I don't fault them for it).

It's not illegal to have a magazine even if it worked better than OEM, so there's no legal difference between the two. If you look at the CRPA guidance document about this bill they don't list magazines under the heading of making a firearm work faster, it's under another section about constructing an "assault weapon". So I don't know their justification for including it in their guidance document but I think that's the reason that stores are also requiring ID for magazines

I really appreciate that input. I assume you're referring to https://crpa.org/wp-content/uploads/2025/11/Info-Bulletin-AB-1263-Guide2341821.pdf.

It pretty much cements it; magazines are considered a "firearm accessory". It's because the bill includes mention of penal code section 30515 in the definition of firearm accessory. So, because any magazine could be used as a part in the construction of an assault weapon, then it's included in the definition. Oh well.

for now that seems like what it is, eventually DOJ will have to clarify what exactly is included but who knows when that will happen.
 
Well, I just learned of this law. My ebay order for one tiny 10rd magazine was canceled and they cited this law.

Some sellers will sell it if you give proof of ID and you'll have to sign for the delivery which just isn't practical unless you work from home.

Next road trip will have to include stops at gun stores.
 
We are starting to hijack this thread, but I think the original poster is trying to make sense of vendor (over) reactions to the new law. It won't make sense and you can't convince them. Some will ship, some won't.

My Ffl said he accepted a Sling delivery for a client where a vendor would not ship. A sling....
Also some AR wrenches are on Amazon if willingly to compromise brands, currently still shipping.

I would also try Magpul their list of prohibited California items does not have magazines in it. You might be able to get some from there.
 
Um,how about a magazine in a paper envelope inside a magazine. Buy a magazine for the read and like cracker jacks, ya get a free prize inside!
 
Not sure why, but I ordered two 10rd mags for my Echelon 4.0C on 1/28 without any hassle. Even got a 15% off code for registering my guns online. Received a week later. I guess it depends on the vendor.
