Attacking dog?

  • People v. Fitzsimmons (2024): Michael Fitzsimmons was convicted of animal cruelty after shooting a neighbor's dog in the face in San Diego. Fitzsimmons claimed the dog lunged at him and he only intended to "frighten" it. However, surveillance video and witness testimony indicated the dog was merely barking and did not pose an imminent threat. The court sentenced him to one year in custody.
  • Novato SWAT Officer Case (2022): A Novato police officer, Darren Crail, shot a neighbor’s dog, Huck, that had escaped its yard. Crail claimed the dog was lunging at him. However, a veterinarian’s examination found the dog was shot from behind (one bullet in the shoulder and one in the back of the head), contradicting the claim of an imminent frontal attack. In 2025, Crail pleaded no contest to willfully harming the dog and was sentenced to probation.

Dog was attacking neighbors pig.
Neighbor was not home during this event.
Was not on my property so used a bat to stop the attack.
Got bit during all this.
Pig had to be put down and dog sent to vet.

Asked neighbor if he gives me permission to use a firearm on his property.
He put it in writing and the dog owner has been warned.
Dog owner was fined by animal control and had to pay for pet pig.

Having your sisters dog killed and her face ripped off is not acceptable.
This is not your sisters fault.
You have to get animal control involved.

Not sure if anyone has seen what a pack of "nice family" dogs can become.
Just like people once in a group they feed off each other.
The hunt and taste of blood will change them forever.

I blame the owner but unfortunately the dog pays the ultimate price.

As others have noted, pepper spray is the best deterrent. There have been instances of people shooting at dogs, missing and then hitting people they didn’t intend to shoot. Pair that with the legal reasons people already noted and it makes the clear best choice to spray them as they approach.

I’m not sure how big your in law’s dog is, but if it is large enough to pull her a bit, I wouldn’t recommend placing the pepper spray on the leash because you don’t want the force her own dog is applying to the leash to interfere with her being able to aim the spray.

What type of spray did you get her? Not all pepper spray is of equal effictiveness. Did you also get her an inert canister or two to practice with? You don’t want her first time ever trying to use the spray to be when everything is on the line. She needs to practice and familiarize herself with the spray.

I get it, but not a big fan of pepper spray. An attacking dog will be all over the place, coming from different directions. If only one direction, you KNOW that will be upwind of you just as you push the button. Now not only being attacked, you can't see 💩.

The big difference though is you don't have to wait to be attacked, you can use it as soon as a dog is acting aggressive and entering your space. Also easier to do one handed, both times I've used pepper spray on a dog I had my own dogs collar in my off hand for control.

Can you please show me an instance where a defender was rendered incapable of defending themselves by blowback from their own pepper spray? I know I can show you many instances where pepper spray worked as intended. Also, what does a single dog coming from different directions even mean?
 
Absolutely yes. You can shoot the dog. Simply stating to preserve life while fearing for your life and safety.

You don’t know if the dog has rabies.

It sucks being in California because anytime you use your gun they will prosecute you to the full extent of the law.

This being fully funded by stolen money from the people in the form of taxation under threat of imprisonment if you don’t allow them to steal your money.
 
Of course you “can shoot a dog”, but I’m not sure “Simply stating to preserve life while fearing for your life and safety” will be enough to prevent legal or civil actions if there are no witnesses.

You - “Officer the dog was big, unsure of rabies status, I was scared, and feared for my life, so I fired 3 shots at it”
Cop- “Thank you good citizen, you are free to go as you were protecting the public”
Passerby- “The first shot hit me in the leg, but thank you for protecting us all Good Citizen”
Dog Owner “Thank you for shooting my dog, as it was probably going to attack you”
Local News - “Good citizen shoots big dog and gets key to the city by Mayor Johnson”

How much more effective do you think the REI Bear mase are compared to those smaller self defense pepper spray or gel on the dog? The Bear mase can should be bigger in capacity, girthier in grip, and with more fluids to distribute; would it not? Has a nice handle for the D-ring folks to loop? Gunfighters inc makes a kydex holster for bear mase.

Doesn't bear spray sort of shoot a wider mist "cloud" type pattern where as the pepper spray outputs a stream?
 
I say just let 'er rip. Juice the attacking dog, the dog walkers teacup Pomeranian (that breed screams testosterone) and maybe there will be just enough for the dog walker himself... everyone can partake

Oops. Yeh, I wonder if it’s more concentrated. 🤣

Wow, no, I didn’t think of other dog walker being tainted too. I was thinking more of a random stray running up and taking bites. Same with the thought of the billy club case outcome. But probably looks pretty bad with a collapsible steel baton compared to pepper spray/gel/bear mace.

I have whacked a stray dog on the snout with a chuck it, it did actually work

My experience of a dog fight it would be hard to just spray one dog. Most likely you will be spraying both dogs as you don’t want to wait to try to find the perfect spot and time to just get the attacking dog. Just spray and take your dog home or to the vet to get cleaned up.

Carry the pepper spray do not attach to leash as you may have to let go of the leash.
