Law 3 in 30 rejection.

I was just rejected for 3 in 30 because my DROS was a day early… actually about 3 hours early (oops).

Has anyone else had this happen? If so, can I re-DROS this week?

Well that’s ridiculous.. I was trying to find that in the written law but haven’t found it yet. That would certainly complicate things!!

I have been trying to read the actual penal code regarding this. From what I can see, I should still be able to get firearm this week but the rejected DROS might actually count towards the rolling 30 day count. So I will have to wait longer for the next purchase.

Can anyone else confirm this?

Yes, it is ridiculous, but that is the nature of the CA DOJ. That is how they treat it, regardless of anything else. You can call them and ask them as that is who matters as they control and program the CA DES DROS system. You can ask the dealer, but they are not the actual source and may or may not know the answer.

The FFL's answer is also speculation, only the CA DOJ can give the actual answer and only if you talk to a person who actually knows.

The submission is an application to purchase and that causes the 30 day clock to reset from that point in time.

I see you are a "Verified FFL" so this sounds like speculation. I'm kidding of course and I know that FFLs can often be quite clueless about these things

Yes the clock resets.. but my interpretation of that is the rolling 30 continues from there. I just read the penal code from the source. I will call DOJ on Monday to confirm, but it seems it may be counted as 1 of 3 applications within 30 days.

So the situation in detail is this. July 31st in the afternoon, I applied for a set of 3 firearms. That set the 30 day clock from there. Today I applied to pick up a rifle that was waiting to be DROS’d at 10am. I should have waited until later this week but I was going to be busy for the rest of this week to get the Rifle. It was a stupid move since I miscalculated the 30 days. I was technically shy by 4 hours.

I would be freed from the rolling 30 tomorrow for 3 firearms.

My interpretation based on the code is that the clock resets today for 1 of 3 in a 30 day period starting today. So I can only do 2 more applications before September 30th. (Including the reapplication for this rifle)

FFL03 + COE is worth it for a variety of reasons (obviously the primary one being ammo shipments direct to you), but the other less obvious benefit is exemption from the 3 in 30 restriction.

I was also recently rejected for this on August 18. Dealer told me to come back on September 19. This was at On Target in Laguna Niguel.

Interesting. Do you know if DOJ has published anything confirming that a 3-in-30 rejection itself starts a new 30-day period? I couldn't find it in the statute.

I have a buddy who attempted to DROS a 2nd gun 1 day short of the 30. It failed the DROS. Turner's told him he has to wait 30 more days now. He went to Sportsman's 2 days later, started a new DROS, and it was approved.
