I applied back in August 2024 and think I may be receiving the interview call within the next couple of months based on other timelines I’ve seen. I was arrested in March 2018 and convicted in November 2018 with a DUI and had 3 years of summary probation. Now, SB 2 says, a person is deemed disqualified if
“(7) In the five years prior to the licensing authority receiving the completed application for a new license or a license renewal, has been committed to or incarcerated in county jail or state prison for, or on probation, parole, postrelease community supervision, or mandatory supervision as a result of, a conviction of an offense, an element of which involves controlled substances, as described in Sections 11053 to 11058, inclusive, of the Health and Safety Code, or alcohol.”

It’s been over 5 years since my arrest and conviction, but my probation didn’t end until 11/2021. Would this mean I’d be automatically disqualified? Would I tell the investigator to just put me at the bottom of the waiting list again and try to reapply next year so I don’t get a denial in my record?

Disappointed since I’ve kept a clean record since then, but don’t want to risk a denial. Appreciate any help.
 
better to be honest from the get go and counter off with what you just said, rather than them seeing what you have on their computer and you not mentioning it. just my advise.

I wouldn’t even dream of not disclosing. My only issue is if the text in SB 2 is 5 years from the date of conviction or the end of probation. I’m assuming probation which means I’ll have to wait an extra year.

Tough since I literally received the invitation to fill out my application and an interview date this morning after submitting this post last night.

Might try to reach out to an investigator and see what their take is.

(a) Unless a court makes a contrary determination pursuant to Section 26206, an applicant shall be deemed to be a disqualified person and cannot receive or renew a license pursuant to Section 26150, 26155, or 26170 if the applicant:
That is a dead stop for the IA. They would have to deny you and then you would always have to divulge you’d been denied.

Reach out to them and explain what you’ve just discovered as you were doing due diligence as an applicant. Better to get the answer and withdraw the app rather than sitting the interview and getting denied.

Thanks for the info, I’ll try to get in touch with as soon as I can. Just can’t believe I got the interview date the morning after creating this post after waiting years to put time and distance between me and the DUI. Rather wait an extra year than get a denial.

In the past, some IAs used 7 years for DUI clearance. SB 2 saved you 2 years! :)
