I join Judge VanDyke’s excellent opinion.
I also write separately to highlight how California has
apparently resorted to subterfuge to deny its citizens their
Second Amendment rights. California insists that citizens in
counties with populations fewer than 200,000 people can
apply for an open-carry license. Yet California admits that
it has no record of even one open-carry license being issued.

How could this be? One potential reason is that California
has misled its citizens about how to apply for an open-carry
license.

I think kostas has it wrong, as he sought to carry in the above 200k parts of the state, they support that.
 
I'd like some of the "smart"/"right" people from the old CGN days to at least tip their hat to Mr. Baird. Against all the odds, he managed, first a 9CA remand after the trial judges shenanigans and then an outright win on the merits from a 3-judge panel. Yes, he will be en banc'd but he did was a lot of those guys claimed would never happen.
 
Watching this one closely. With 46 states allowing open carry with some restrictions, maybe this one heads all the way to the Supreme Court and the restriction is eliminated. CCW open or concealed. Maybe. I think the mag restriction, roster restriction, featureless, where to carry, etc are more important restrictions to overturn. IMHO

I think even if open carry was legal, I would tend not to. Not sure on the real world benefit vs the real world risks.
 
Only reason I have to carry a gun, open or concealed, would be hiking in the boondocks, to deal with Mt Lions or the odd non-lazy psycho.

I would have no problem with open carry in those circumstances.
